These terms govern your use of Development Capital. By using the platform you agree to them.
Your account
You are responsible for the accuracy of information you provide, for activity under your account, and for keeping your credentials secure. You must have authority to act for the organisation you represent.
Acceptable use
Do not misuse the service, attempt to access data belonging to other organisations, interfere with its operation, or use it unlawfully. Access between organisations — lender, developer, superintendent, QS and builder — is governed by the permissions you grant.
Your data
You retain ownership of the facility, project, claim and certification data you enter. You grant us the rights needed to host and operate the service for you. You are responsible for the lawfulness of the data you upload.
Not financial or legal advice, not a lender
The platform provides software tools for SOP Act compliance tracking, claim certification workflow and drawdown evidence. It does not provide financial, legal, valuation or credit advice, and Development Capital is not a lender or credit provider. Funding facilities are arranged and administered directly between the lender and borrower; the platform records and evidences that process but is not a party to it.
Availability and liability
The service is provided on an "as is" basis. To the extent permitted by law, we exclude implied warranties and limit our liability for indirect or consequential loss. Nothing in these terms excludes rights that cannot lawfully be excluded, including under the Australian Consumer Law.
Governing law
These terms are governed by the laws of New South Wales, Australia.
